1. Data protection

Data protection is a matter of trust and your trust is important to us. In order for you to feel safe when visiting our website, ÖSD strictly observes the legal provisions regarding the processing of personal data and we would like to inform you here about our data collection and use. In this privacy policy we outline which of your personal data is collected when visiting our website, which of this data is processed or used and how, and who you can contact in case any questions arise.

 Please note that the internet-based data transfer (e.g. during communication by e-mail) may pose security risks. It is not possible to completely protect such data against access by third parties.


2. Responsible authority

3. Rights of data subject - access, blocking and deletion of data

You are entitled at any time and free of charge to request information about your personal data we store and to exert your right to the correction, blocking or deletion of your data. Please use the contact details stated above for this purpose. To partially or completely revoke your consent regarding the collection, processing and use of your data by ÖSD within the framework of this privacy policy, please send an e-mail or letter to the aforementioned contacts.


4. Right of appeal at the responsible supervisory authority

In case of violation of data protection laws, the persons concerned have the right to file a complaint with the Österreichische Datenschutzbehörde Wien (Austrian Data Protection Authority Vienna) as the responsible supervisory authority. 5. Collection and use of personal data

Personal data is data which contains information about the personal and factual circumstances of specific or identifiable users. This can include e.g. name, telephone number, postal address as well as any statistical data.

When you visit our website or communicate with us, you may disclose personal data about yourself including data which might allow personal identification (”personal data“).

The following data may be gathered automatically when you visit our website:

  • your IP address
  • login data
  • location
  • browser plugin-types and versions
  • operating system and platform
  • information about your visit including your URL clickstream data (sequence of page views on our website)
  • download errors
  • the duration of your visit to certain pages and interactions between the sites

 

Different technologies are used for the automatic collection of data. The data collected automatically is used

  • for internal purposes to administrate our website including debugging,
  • to ensure an optimised display of its content on all your devices,
  • to safeguard protection and security and
  • to present website users interest-based relevant recommendations for products and services.

6. Distribution and disclosure of personal data

We may disclose your data according to the purposes outlined in these guidelines to affiliated third parties and other parties mentioned herein.

We may also disclose your data to third parties

  • (e. g. within social media) upon your specific request, or
  • if necessary to ensure the security and protection of our users, customers and other third parties, our own rights and property, as well as the rights and property of our guests or third parties,
  • if it is necessary to include selected external service providers in order to facilitate or enhance our services,
  • if obliged to do so due to statutory or official provisions,
  • if it is imperative to enforce our terms and conditions, or
  • with respect to the sale or transfer of the enterprise.

Art. 6 para. 1 lit. b GDPR regulating the processing of data for the fulfilment of a contract or of pre-contractual measures is the basis for the processing of data.


7. Server log files

The provider of this website and its pages automatically collects and stores information in so-called server log files, which your browser transmits to us automatically. The information comprises:

  • type and version of browser used
  • operating system used
  • referrer URL
  • hostname of the accessing computer
  • time of the server inquiry
  • IP address

This data is not merged with other data sources. This data is processed on the basis of Art. 6 para. 1 lit. b GDPR which allows data processing for the fulfilment of contractual purposes or for the implementation of pre-contractual measures.


8. Contact form

If you contact us via the contact form provided on the ÖSD website, we will store your contact details as well as other data for the purpose of answering your request and any other requests you may have in the future. We do not transmit your personal data to third parties without your consent. Your personal data provided on the contact form is processed solely upon your consent (Art. 6, para. 1, lit. a GDPR).
You may revoke your consent at any time by sending an e-mail to datenschutz@osd.at. The legality of the processing of data prior to the revocation shall remain unaffected by such a revocation. We store the data provided by you via the contact form until you instruct us to delete it, revoke your consent to its storage or the purpose for the data storage becomes void (e. g. after successfully processing your request).
Mandatory statutory provisions, in particular retention periods, shall remain unaffected.


9. Secure data transmission

For safety reasons and to protect the transmission of confidential content, such as enquires etc. that you sent to us as the website operator, this website uses SSL/TLS encryption. You can tell whether an encrypted connection is used by looking for the padlock symbol in the status bar of your browserand  the URL address will change from http:// to https://. If SSL/TLS encryption is enabled, third parties cannot, during transmission, read the information transmitted by you. We also employ technical and organisational measures in order to safeguard our website and other systems against loss, destruction, access, changes, modification and distribution of your data by unauthorised parties. Any data you make available to us is stored on secure servers.


10. Data storage

ÖSD shall not retain your personal data for longer than is necessary for the business purposes described above, unless this data is necessary for complying with a statutory obligation, for providing a service you have requested or unless you have given your consent.


11. Google Analytics

For website use analysis, this website uses the service “Google Analytics” provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). The service uses text files (so-called “cookies”) which are stored on your device. The information collected by means of cookies is usually transmitted to a Google server in the USA and stored there.

IP anonymisation is activated on this website. The IP address of users will be shortened prior to transmission within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area, by means of which a localisation or personal identification is no longer possible. Within the context of the data processing agreement between the website hosts and Google LLC, the information gathered serves the purpose of website use analysis and services related thereto.

You have the option to prevent the storage of cookies on your device by changing your browser settings accordingly. In this case you may, however, not be able to use all of this website’s functions to their full extent.


12. Third-party tools and analysis tools

Upon visiting our website, your surfing behaviour can be statistically analysed by means of so-called analysis tools. As a rule, the analyses of your browsing patterns are conducted anonymously, which means that these cannot be traced back to you. You have the option to prevent such analysis by using certain tools.


13. Services and content provided by third parties

This website also includes third-party contents such as YouTube videos , map material from Google Maps or illustrations from other websites. For the transmission of contents to a user’s browser, these providers (hereinafter referred to as “third-party providers”) require the user’s IP address, without which the display of contents is not possible. We strive to only provide content from third-party providers contents that use the IP address  exclusively for the transmission of content. However, we assume no responsibility for any third-party providers storing the IP address, for example for statistical purposes.

For sending information via e-mail to existing contract partners and licensees, we use the newsletter service Newsletter2Go based in Germany, Köpenicker Strasse 126, 10179 Berlin. Newsletter2Go is a certified German service provider observing the strict requirements of the Bundesdatenschutzgesetz (German Federal Data Protection Act) and the EU General Data Protection Regulation. Further information can be obtained here.

For e-mail transmission, Newsletter2Go is provided with your data (e-mail address). Newsletter2Go is not permitted to sell this data or use it for any other purpose than sending newsletters.

If you receive an e-mail sent via Newsletter2Go, information such as your IP address, browser type and e-mail-programme is stored, which provides us with information about the performance of the sent message. Newsletter2Go can determine whether the e-mail has arrived, whether it has been opened and whether weblinks have been clicked on.

You may at any time revoke your consent concerning the storage of personal information, your e-mail address as well as the use thereof for the transmission of newsletters, e. g. by clicking on the ”unsubscribe”-link in the newsletter.


14. Website use by minors

Website users aged 14 or less must seek their parents’ or legal guardian’s approval before submitting data online. Without this consent, the transfer of data is prohibited. Data transferred to us despite this will not be processed further as soon as we gain knowledge of such a fact.


15. Links to other websites

Our website contains links to external third-party websites. The respective provider or operator always has sole responsibility for the content of the linked pages. As soon as we become aware of a legal violation, we will remove such links immediately.


16. Social networks

Our website uses a plugin for social media buttons which link to the respective service provider webpages. Upon clicking on these buttons, the ÖSD channel at the respective service provider (Facebook, Twitter, YouTube or Instagram) will be opened in a new browser window. The plugin neither collects data nor does it share data with third parties.
